a) When visiting the website
When accessing our website https://earlybird.agency, information is automatically sent by the browser used on your device to our website’s server. This information is temporarily stored in a so-called logfile. The following information is collected without any action on your part and stored until automated deletion:

- Name and URL of the retrieved file,

b) When using our contact form
To contact us, we offer you the option of using an online contact form provided on the website. Personal details and a valid email address are required so we know who the request originates from and to answer it.
Data processing for the purpose of contacting us is carried out pursuant to Art. 6(1) sentence 1 lit. a GDPR on the basis of your voluntarily given consent. Your information will be deleted after termination of the membership unless we are legally obliged to retain your personal data for a limited period or temporary retention is legally permitted to safeguard legal interests in the context of contractual processing.
3. Disclosure of data
Your personal data will not be transferred to third parties for purposes other than those listed below.
We only disclose your personal data to third parties if:
- You have given your express consent pursuant to Art. 6(1) sentence 1 lit. a GDPR,
- a legal obligation exists for disclosure pursuant to Art. 6(1) sentence 1 lit. c GDPR, and
- it is legally permissible and necessary under Art. 6(1) sentence 1 lit. b GDPR for the execution of contractual relationships with you.
4. Cookies
We use cookies on our website. These are small files that your browser automatically creates and stores on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not cause any damage to your device, nor do they contain viruses, trojans, or other malware.

5. Analytics tools
a) Tracking tools
The tracking measures listed below and used by us are carried out on the basis of Art. 6(1) sentence 1 lit. f GDPR. We want to ensure needs-based design and ongoing optimization of our website by using tracking measures. We also use tracking measures to statistically record and evaluate usage of our website for optimization purposes. These interests are considered legitimate within the meaning of the aforementioned regulation.

For the purpose of needs-based design and continuous optimization of our pages, we use Google Analytics, a web analytics service provided by Google Inc. In this context, pseudonymized user profiles are created and cookies (see Section 4) are used. The information generated by the cookie about your use of this website such as:

In particular, you may request information on the processing purposes, the category of personal data, categories of recipients to whom your data has been or will be disclosed, the intended storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right to lodge a complaint, the source of your data if not collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
- request rectification of inaccurate or incomplete personal data stored by us pursuant to Art. 16 GDPR;
- request deletion of your personal data stored by us pursuant to Art. 17 GDPR unless processing is necessary for exercising the right to free expression and information, for fulfilling a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims;
- request restriction of processing of your personal data pursuant to Art. 18 GDPR if you contest the accuracy of the data, the processing is unlawful but you oppose deletion, we no longer need the data but you require it for legal claims, or you have objected to processing pursuant to Art. 21 GDPR;
- receive your personal data provided to us in a structured, commonly used, machine-readable format or request transmission to another controller pursuant to Art. 20 GDPR;
- withdraw consent given once at any time pursuant to Art. 7(3) GDPR. This means that we may no longer continue processing data based on this consent in the future; and
- lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR. You may usually contact the authority responsible for your habitual residence, workplace, or our business location.
7. Right to object
If your personal data is processed based on legitimate interests pursuant to Art. 6(1) sentence 1 lit. f GDPR, you have the right to object to processing of your personal data pursuant to Art. 21 GDPR if there are reasons arising from your particular situation or if the objection is directed against direct marketing. In the latter case, you have a general right to object which will be implemented by us without the need to state a particular situation.

8. Data security
We use the widely adopted SSL (Secure Socket Layer) method during website visits in connection with the highest level of encryption supported by your browser. Typically, this is 256-bit encryption. If your browser does not support 256-bit, we use 128-bit v3 technology instead. You can see whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock icon in your browser’s status bar.
